Terms and Conditions of engaging the services of Absolute Living
1. Introduction PLEASE READ THESE TERMS AND CONDITIONS VERY CAREFULLY BEFORE ENGAGING ABSOLUTE LIVING’S SERVICES. ENGAGING OUR SERVICES IS LEGAL PROOF THAT YOU ACCEPT THESE TERMS AND CONDITIONS. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS, PLEASE DO NOT USE OUR SERVICES IN ANY CAPACITY AND PLEASE FEEL FREE TO CONTACT ABSOLUTE LIVING.
2. Services 2.1. You must be over 18 or obtain the consent of your parent or guardian before accessing Absolute Living’s services. 2.2. You must complete an assessment and/or informed consent before accessing services. All information given must be true and accurate. 2.3. Absolute Living cannot provide emergency assistance, it is therefore not suitable if you are: • experiencing an emergency or crisis • thinking of harming yourself or others • experiencing psychotic symptoms or other serious health-related issues If you are experiencing any of the above, please contact your local doctor or an emergency help line. 2.4 Absolute Living offers Coaching and Training in person, by phone, or by Skype. 2.5 Email responses should be received within 48 hours. Weekends and public holidays may increase this time. 2.6 The information contained or given in any Absolute Living session does not constitute advice for making medical, legal or financial decisions. 2.7 Any changes you choose to make in your life as a result of Absolute Living sessions are solely your responsibility.
3. Payment of fees 3.1 Payment is required either before commencement of any educational event or immediately after a Coaching session, other than seminars. 3.2 Payment is to be made either by means of cash, direct debit or through PayPal to ensure security. 3.3 All prices are in Australian Dollars and are subject to change without notice. 3.4 Any administrative emails (e.g. to query something or to book a live session) incur no fee. 3.5 Multiple sessions offered at a discounted rate i.e. for 4 or 6 sessions must be paid in advance; otherwise the discount does not apply.
4. Cancellation and refunds policy 4.1 To postpone or cancel a booking, you must contact Absolute Living by phone or email at least 48 hours before the booked session time. 4.2 No refund will be forwarded if you fail to postpone or cancel a session and do not keep your booked appointment if less than 48 hours notice is given. 4.3 If you have not communicated with Absolute Living yourself for a period of one month, but have not indicated that you plan to be away or wish to terminate the service, Absolute Living may send you an enquiry email. If there is no reply to this email within one week, your service will be cancelled. Paid for in advance monies will be refunded, minus a 10% cancellation fee if this occurs. 4.4. If a client is attending an event, they are only entitled to a full refund if they decide to leave within the first thirty minutes after commencement once they have notified one of the staff members. If they pay in person with cash, they will be refunded immediately however if they paid electronically, the refund will occur as-soon as practical however, within one week. No monies will be refunded after a thirty minute period from commencement of an event under any circumstances.
Termination 4.5 You may choose to terminate services at any time and are asked to inform Absolute Living by email so that monies may be refunded as soon as possible (within a maximum of one week). Please ensure you understand the refund policy of Absolute Living if a refund will be applicable. If it is found that Coaching is not appropriate for you, Absolute Living will assist you with referrals to a more appropriate service. 4.6. Failure to pay for an Absolute Living service after a two week period, will result in a termination of your access to our services and you will not be able to engage any of our services again. If you continue to pay for a service late (please refer to our payment policy for our services), your access to engage our services will end. 4.7 Inappropriate or abusive behavior will result in the immediate termination of our services. No refund will be payable for the session in which the abuse occurred and Absolute Living may begin legal proceedings, dependent on the severity of the abuse. 4.8 Absolute Living reserves the right to terminate services if you provide false or misleading information, or if you are found to have breached these terms and conditions. 4.9. If you are found or are reasonably believed to be engaged in an illegal activity during using an Absolute Living service (e.g. under the influence of illegal drugs, stealing from a premise where Absolute Living's services are offered, etc), your service will be terminated immediately for an indefinite period and you may be subject to immediate arrest and possible corresponding legal proceedings.
5. Technical issues 5.1 If you are having difficulty contacting Absolute Living or connecting to the internet at the appointment time scheduled, the session will continue to be available for the stipulated time. The session however cannot be extended. 5.2 Please contact Absolute Living as soon as possible to arrange another appointment. No refund will be forwarded if Absolute Living does not hear from you within the time scheduled. 5.3 If Absolute Living is having operational difficulties you will be contacted and another appointment time rescheduled. 5.4 Absolute Living holds no liability if our business is unable to provide its services to you however Absolute Living will either reschedule appointments or refund your money to a nominated account within one week.
6. Confidentiality 6.1 Absolute Living adheres to Australia’s National Privacy Principles as set out in the Privacy Act 1988, amended by the Privacy Amendment (Private Sector) Act 2000. 6.2 The utmost care is taken to protect client confidentiality however it is mandatory that Absolute Living notifies the proper authorities if the following circumstances deem we have a right to exercise our legal Duty of Care on behalf of our business and in the best interest of the general public: • If it is deemed that a client may be of harm to his/herself • If a client discloses intent to cause any form of physical or sexual harm, abuse and/or neglect to other people. • If records are subpoenaed by court order. 6.3 Except in the case of mandatory notification, access to your personal information by any other person is strictly prohibited unless both parties agree to it in writing and provide a statutory declaration to prove their identities (e.g. passport and drivers license). 6.4 To ensure best practice, Absolute Coaching contractors and employees, undergo regular supervision. During this time cases are discussed, however personal details will never be disclosed at any stage without your consent first. 6.5 Absolute Living takes reasonable steps to ensure the security of all information passing between the server and the client's browser however Absolute Living cannot guarantee that your transactions are not being viewed, intercepted or modified by third parties. 6.6 Absolute Living accepts no responsibility or liability of any kind for breaches of security, privacy or confidentiality that occur on computers, computer networks, telephones, telephonic equipment or any other form of equipment as a result of unauthorized access. 6.7 No information collected by Absolute Living will be passed on to any other party or parties for commercial use. 6.8 Absolute Living may ask you for feedback on the services provided. Such information may be used to improve or promote our website and services. By providing testimonials and feedback you acknowledge that Absolute Living is free to use that information without any compensation to you.
7. Privacy 7.1 You are wholly responsible for protecting the privacy of any information you receive as well as any passwords and username information. 7.2 You should ensure your sessions are not observed by others and that you will not be interrupted during a session. 7.3 Ensure you log out and close your browser window when you complete your session. This is solely the client’s responsibility. 7.4 If you share a computer, it is recommend that a Hotmail, Yahoo or Gmail email account is used so that a unique username and password is required to access alert emails. 7.5 Coaching and Personal Development sessions are intended for the client's use only. This information is not to be shared with others as it is tailored to your individual situation. 7.6 Records of coaching sessions will be kept for a minimum of five years in a secure location and the hard copy records will be archived. 7.7 You must provide a detailed written request if you wish to view your client records and a statutory declaration that verifies your identity if not requesting them in person. 7.8 Absolute Living is happy to provide you with access to any personal information that we hold about you. If it is wrong, please ask us to correct it. 7.9 Records will be destroyed in a manner that protects privacy. 7.10 Your privacy and collection of personal information provided to us is top priority at Absolute Living and will never be shared to any third party for any reason without your written consent first, unless required by law. It will not be sold, rented or loaned to anyone, any business or organization at any time without your written consent first, unless required by law.
8 Limitation of Liability 8.1 Absolute Living holds no liability to any person in respect of any loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or any costs, claims, damages, proceedings and expenses (including without limitation, legal expenses) as a result of viewing or accessing any Absolute Living services. 8.2 Absolute Living shall not be liable for any damages of any kind including, but not limited to direct, indirect, incidental and consequential damages resulting from a client's failure to provide information or having provided false information with regards to his/her suitability to receive any of Absolute Living’s services. 8.3 Absolute Living assumes no responsibility and shall not be liable for any damages or loss or corruption of information or data resulting from computer viruses, disabling codes, worms or other devices or defects that may infect a client or viewer's computer equipment resulting from your access to or use of our business website. 8.4 Absolute Living website and services are provided “as is.” Absolute Living makes no representations or warranties express or implied in-relation to this website or the information, materials, and services provided on by Absolute Living and our website.
9 Indemnity 9.1 The client agrees to indemnify Absolute Living, its partners, agents, officers, contractors, employees and other authorized representatives against all claims, suits, demands, damages, liabilities, costs or expenses arising in any way out of or in any way connected to his/her use of this website and services. 9.2 The client agrees that Absolute Living coaching and other personal services take place in Australia and are governed by and interpreted according to the federal laws of Australia and the state laws of Queensland.
10 Disclaimer All information and services are for general informational and educational purposes only. As such, they cannot account for an individual’s mental health or personal circumstances. They are not intended as a prescription for care and should not replace the advice of the client's mental health practitioner or other professional services that an Absolute Living client may already be engaged in or in the process of engaging. 10.2 Absolute Living holds no responsibility and will not be held liable for the content (including terms and conditions and privacy policy) of any other website linked from Absolute Living’s website. The links to any such third party websites are provided for convenience and information only. If you access these websites you do so at your own risk. Conversely, Absolute Living will not be held liable for any actions or incidences that may occur as a result of referral to and the subsequent use of’, another health professional and other professional business/persons and will not be held liable for any problems arising from engaging others professional services. 10.3 The fact that a website or the services provided for by another professional service is linked to the Absolute Living business, does not imply any endorsement, sponsorship or liability by Absolute Living in any capacity whatever. 10.4 Whenever engaging Absolute Living’s services in any capacity, it is the client’s responsibility to: (a) Inform Absolute Living Personnel of any preexisting mental and health issues that may endanger either their own health or the health/life of another person. (b) Clients must have any medications on them that they have been prescribed to use. This is the client’s responsibility, not Absolute Living's’. (c) If they feel that they their own health or that of someone else close to them could be in danger as a result of their condition, they must inform Absolute Living personnel of these issues prior to the commencement of any of, or during a Absolute Living session and seminar. (d) If the client at any stage does not feel comfortable whilst engaging any of Absolute Living’s services, they reserve the right to end that session or leave an informational/educational event with or without disclosing their reasons. In the advent a client chooses to do-so at a educational event, they must without disrupting the event in any way, otherwise the appropriate authorities will be informed and action taken, including possible legal proceedings thereafter if warranted. If a client is deemed by any of Absolute Living’s staff (including the owner) to be excessively disrupting any of the services provided, Absolute Living personnel (including the owner) can ask to the person disrupting the service to either discontinue the disruption or leave the event. If that person refuses t to leave after three verbal requests, both the police and venue security services will be notified and services/the event may be temporarily suspended until such time as the disruptive person is removed. Services will then resume as normal. (e) Absolute Living staff are all First Aid qualified and in the advent a client needs medical attention, Absolute Living personnel are legally bound to provide assistance within the level of their First Aid training providing they are not endangering either themselves or others. If you have a known medical (including mental) condition, it is your responsibility to advise Absolute Living personnel and your personal duty of care not to knowingly endanger or mislead others , including Absolute Living personal in either a way that would endanger them or others. If a client is found to be delib either misleading or deliberately withholding this type of information, their services can be terminated immediately, no refunds will be allowed and they will possibly face legal action from Absolute Living. In the advent of an event, they will be asked to leave however after three verbal requests, escorted out by Absolute Living staff and/or security personnel.
11. Copyright 11.1 All material and information provided by Absolute Living remains the intellectual property of the owner of Absolute Living. 11.2 You, the user, are solely responsible to abide by copyright laws; and may not copy, reproduce, retransmit, distribute, transfer copyrighted material, or publish for commercial purposes any information, material, or content from Absolute Living’s website or any of our services offered, including seminars and other informational events. 11.3 Material is provided by Absolute Living for your own personal development purposes only and is not to be shared or distributed in any other manner under any circumstances whatever without the consent of the director of Absolute Living first. Such material is tailor-made for the individual’s needs and may be harmful to another person.
12. Changes in Terms and Conditions 12.1 Absolute Living reserves the right to change its Terms & Conditions at any time without notice.
Absolute Living Spiritual Development Group Disclaimer:
Anyone wanting to attend Absolute Living’s Spiritual Development Group must be at least 18 years of age or accompanied by a legal guardian. Absolute Living’s Director & staff reserve the right to request proof of age should they suspect a person is less than 18 years of age. If a person is found to be less than 18 years of age and is not accompanied by a legal guardian, they will not be able to attend this group activity. All intuitive readings and advice, both free and paid for as part of any of Absolute Living’s services, including from Clint O’Regan, an Absolute Living staff member or from someone attending the Spiritual Development Group, are intended to empower you to take responsibility for making the best choices for yourself.
Clint O’Regan and Absolute Living staff members are not responsible for any action or inaction on your part as a result of you attending the Spiritual Development Group or any other service provided by Absolute Living. You agree to take full responsibility for your life. No opinions or information expressed in any format or private consultations from Absolute Livings’ services are not to be considered as any kind of medical, psychological or professional diagnosis or treatment for any condition. Do not ignore advice from a qualified professional based upon any information given to you during the group session or a consultation by Clint O’Regan or an Absolute Living staff member. Information exchanged during the group activity is confidential however if information on serious abuse or crime is revealed in a session or conversation, it will be reported to the proper law enforcement and/or governmental authorities.
I also understand that if I have any pre-existing serious physical and psychological ailment or other serious non-health related issues, it is strongly recommended that I see the relevant licensed professional as applicable before attending this group and all information relating to serious health issues, physical or mental, must be reported to Clint O’Regan or an Absolute Living staff member before attending this group activity. In the advent you suffer a medical emergency during any stage of attending any of Absolute Living’s services and you do not inform Absolute Living’s staff of these pre-existing conditions, then Absolute Living will not be liable for any legal actions that may result from this.
I understand that Clint O’Regan and Absolute Living Staff members cannot make any warranties or guarantees regarding the information provided and therefore cannot be held responsible or liable for the actions you take as a result of using Absolute Living’s services. You are completely responsible for any actions you take after engaging any of Absolute Living’s services.
